The elements and information transmitted by the User shall enjoy full legal effect, with the User acknowledging the electronic purchases, and the User may not claim lack of signature for breach of the obligations assumed.<\/p>\n<p><strong>Product and Content Information<\/strong><\/p>\n<p>HaHaArt will make every effort to ensure that the information provided is error-free, and any errors that do occur will be promptly corrected as soon as they are detected. In the event of purchasing a product that has different characteristics to those presented online, and always without prejudice to the right of withdrawal, the User has the right to terminate the purchase contract under the applicable legal terms.<\/p>\n<p>HaHaArt will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes difficult for HaHaArt to control, such as human errors or incidents in computer systems, it will not be possible to provide some of the products ordered by the User. If a product is not available after the order has been placed, the User will be notified by e-mail or cell phone. You will then be offered the chance to cancel the order with a refund, if you have already paid.<\/p>\n<p>All information about prices, products, specifications, promotional actions and services may be changed at any time by HaHaArt.<\/p>\n<\/p>\n<p><strong>Responsibilities<\/strong><\/p>\n<ol>\n<li>All products and services sold in the HaHaArt Online Shop are in accordance with Portuguese law.<\/li>\n<\/ol>\n<ol start=\"2\">\n<li>The Store has adequate security levels, however HaHaArt shall not be liable for any damages suffered by the User and\/or third parties due to delays, interruptions, errors and suspensions of communications that originate from factors beyond its control, namely any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or arising from the downloading (&#8220;download&#8221;) through the service of files infected or containing viruses or other properties that may affect the User&#8217;s equipment. If for any reason access to the HaHaArt Online Store website is not possible, HaHaArt shall not be liable for any damages.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>The data and information consultations carried out within the scope of this Service are presumed to have been carried out by the User, and HaHaArt declines any responsibility arising from the abusive or fraudulent use of the information obtained.<\/li>\n<\/ol>\n<ol start=\"4\">\n<li>HaHaArt shall not be liable for any loss or damage caused by misuse of the Service that is not directly attributable to HaHaArt through willful misconduct or gross negligence.<\/li>\n<\/ol>\n<ol start=\"5\">\n<li>HaHaArt does not guarantee that:<\/li>\n<li>i) the Service is provided uninterruptedly, is secure, error-free or works infinitely;<\/li>\n<li>ii) the quality of any product, service, information or any other material purchased or obtained through the Service fulfills any expectations of the User in relation thereto;<\/li>\n<\/ol>\n<p>iii) any material obtained in any way through the use of the Service is used at the User&#8217;s own risk, and the User is solely responsible for any damage caused to their computer system and equipment or for any loss of data resulting from such operation.<\/p>\n<ol>\n<li>iv) no advice or information, whether oral or written, obtained by the User from or through the Service shall create any warranty that is not expressed in these General Conditions.<\/li>\n<\/ol>\n<p><strong>Consumer obligations<\/strong><\/p>\n<ol>\n<li>The user undertakes to:<\/li>\n<li>i) Provide personal data, such as name, mobile number, e-mail and correct addresses, so that the respective orders can be sent;<\/li>\n<li>ii) Do not use false identities;<\/li>\n<\/ol>\n<p>iii) Respect the conditions and values of the HaHaArt store.<\/p>\n<\/p>\n<ol start=\"2\">\n<li>If any of the data is incorrect, or insufficient, and for this reason there is a delay or impossibility in processing the order, or possible non-delivery, the responsibility lies with the User, and HaHaArt declines any responsibility. In the event that the consumer violates any of these obligations, HaHaArt reserves the right to eliminate future purchases, block access to the store, cancel the provision of any other services made available simultaneously by HaHaArt to the same User; and also not allow the User future access to any or all services made available by HaHaArt.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>It is expressly forbidden to use the products purchased for commercial purposes, namely for resale.<\/li>\n<\/ol>\n<p><strong>Privacy and Personal Data Protection<\/strong><\/p>\n<ol>\n<li>The User&#8217;s personal data will be processed by the company HaHaArt, with headquarters at Pra\u00e7a Manuel Henriques J\u00fanior, 3100-500 Pombal.<\/li>\n<\/ol>\n<p>HaHaArt is therefore the entity responsible for processing the User&#8217;s personal data. HaHaArt applies various appropriate technical and organizational measures to protect the User&#8217;s personal data.<\/p>\n<\/p>\n<ol start=\"2\">\n<li>The personal data collected by HaHaArt are those identified on the order form:<br \/>-name;<br \/>-complete apartment;<br \/>-mobile phone number;<br \/>-email.<br \/>The data marked as mandatory is indispensable for HaHaArt to provide the service. The omission or inaccuracy of the data provided by the User is their sole and entire responsibility and may result in HaHaArt refusing to provide the service.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>The User&#8217;s personal data will be processed and stored by computer and is intended to be used by HaHaArt within the scope of the contractual and\/or commercial relationship with the User, namely with a view to concluding and executing the purchase and sale contract, processing and informing about the status of orders and communication with Customers, processing requests for information, processing any complaints, complying with legal obligations (e.g. keeping invoices), exercising HaHaArt&#8217;s rights and legitimate interests and when consent is given by the User. HaHaArt only keeps your personal data for as long as is necessary for the purpose for which it was collected.<\/li>\n<\/ol>\n<ol start=\"4\">\n<li>HaHaArt may communicate the User&#8217;s personal data to third party service providers, such as companies involved in the purchase process, storage and transportation of orders, website hosting and banking agencies. These entities will only be provided with the personal data strictly necessary for the provision of the service in question, and they undertake to process such data solely for the fulfillment of the aforementioned purposes.<\/li>\n<\/ol>\n<ol start=\"5\">\n<li>Under the terms of the applicable legislation, the User is guaranteed, without additional charge, the right to access, rectify and update their personal data, the right to limit the processing of their personal data and the right to portability of that data. HaHaArt reserves the right not to process any order or refund in the event of errors in the values and\/or characteristics of the products, when these are due to factory defects or errors beyond HaHaArt&#8217;s control.<\/p>\n<\/p>\n<ol start=\"3\">\n<li>If the order is canceled, the amount paid by the User when placing the order will be refunded. If a promotional discount code has been used in the order, the amount corresponding to the discount will not be refunded, i.e. the refund will only be for the amount actually paid.<\/li>\n<\/ol>\n<p><strong>Exchanges<\/strong><\/p>\n<ol>\n<li>Exchanges can be made within a maximum of 14 days, after which HaHaArt will not accept the item in question.<\/li>\n<\/ol>\n<p>If there is a difference in value, this will be charged by sending a Multibanco or MbWay reference, which must be paid 24 hours after the new item has been chosen.<\/p>\n<p>For the purpose of the exchange, the User must provide HaHaArt with the following information:<\/p>\n<ol>\n<li>a) Order number<\/li>\n<li>b) The item you want to exchange.\n<p>Items must be sent to our premises in perfect, unused condition, with the label, invoice and packaging intact. HaHaArt does not exchange jewelry, underwear or socks for hygiene reasons.<\/li>\n<\/ol>\n<p>The shipping costs incurred by the exchange will be borne entirely by the User.<\/p>\n<\/p>\n<p><strong>Intellectual Property<\/strong><\/p>\n<ol>\n<li><u>https:\/\/hahaartfilmfestival.pt <\/u>is a registered site and the Service provided by the site itself is the responsibility of HaHaArt.<\/li>\n<li>The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.<\/li>\n<li>The User acknowledges that any content that appears in the advertising, highlighting, promotion or mention of any sponsor or advertiser is protected by the laws relating to copyright and related rights, the laws relating to industrial property and other property protection laws, so any use of such content may only occur under the express authorization of the respective owners.<\/li>\n<li>The User undertakes to fully respect the rights referred to in the previous paragraph, namely by refraining from any acts that may violate the law or said rights, such as the reproduction, commercialization, transmission or making available to the public of said content or any other unauthorized acts that have the same content as their object.<\/li>\n<\/ol>\n<p><strong>Service safety conditions<\/strong><\/p>\n<ol>\n<li>The User undertakes to comply with all applicable legal provisions, in particular not to practice or encourage the practice of unlawful acts or acts offensive to good morals, such as the indiscriminate sending of unsolicited communications (<em>spamming<\/em>) in violation of the provisions of the legislation applicable to the processing of personal data and advertising communications through automatic calling devices, and must also comply with the rules for using the Service.<\/li>\n<li>The User expressly acknowledges and accepts that the IP Network is a public electronic communications network that can be used by several users and, as such, is subject to computer overloads, and therefore HaHaArt does not guarantee the provision of the Service without interruptions, loss of information or delays.<\/li>\n<li>HaHaArt also does not guarantee the provision of the Service in situations of unforeseeable overload of the systems on which it is based or of force majeure (situations of an extraordinary or unforeseeable nature, external to HaHaArt and which cannot be controlled by HaHaArt).<\/li>\n<li>In the event of an interruption in the provision of the Service for reasons of unforeseeable overload of the systems on which it is based, HaHaArt undertakes to regularize its operation as soon as possible.<\/li>\n<\/ol>\n<p><strong>Suspension and deactivation of the Online Shop<\/strong><\/p>\n<ol>\n<li>Regardless of any prior or subsequent notice, HaHaArt may, at any time, and in its sole discretion, discontinue making the Service and\/or part of the Service available to any or all Users.<\/li>\n<li>HaHaArt also reserves the right to immediately suspend or terminate access to the Service in the following cases:<\/li>\n<li>a) When the User does not comply with the conditions of use referred to in the General Conditions;<\/li>\n<li>b) When HaHaArt ceases access to the Store, by giving 15 days&#8217; notice of the date of cessation.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>The suspension or termination of the Service by HaHaArt pursuant to the preceding paragraphs shall not entitle the User or any third party to any damages or other compensation, and HaHaArt shall not be liable or in any way burdened by any consequence resulting from the suspension, annulment, termination of the Service.<\/li>\n<li>In the situations described above, HaHaArt will notify the User in advance so that he\/she can, if he\/she so wishes, safeguard the content of his\/her order viewing area within 3 working days of the e-mail being sent or the information being made available on the Service&#8217;s main page.<\/li>\n<\/ol>\n<p><strong>Communications<\/strong><\/p>\n<p>Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the User relating to the Service, including any changes to these General Conditions, may be made to the User&#8217;s email address, by SMS or telephone contact.<\/p>\n<\/p>\n<p><strong>Technical Configurations<\/strong><\/p>\n<p>Without prejudice to the provisions of the following paragraph, HaHaArt may change the Service and\/or the technical conditions for its provision, as well as the respective rules of use, and shall disclose such changes to the User at least 15 days in advance.<\/p>\n<\/p>\n<p><strong>Complaints<\/strong><\/p>\n<p>For complaints, HaHaArt customers can use the Electronic Complaints Book available here https:\/\/www.livroreclamacoes.pt\/Inicio\/.<\/p>\n<\/p>\n<p><strong>Applicable Law and Alternative Dispute Resolution<\/strong><\/p>\n<ol>\n<li>For any divergence arising in the contractual relations between the Parties, Portuguese law shall apply. Any question or dispute arising from the application, interpretation, integration or execution of this Contract, when it cannot be resolved by agreement of the parties, shall be submitted to the Portuguese courts. Our analysis is extremely rigorous and if the item is not intact, the exchange will not be made. In this case, the product will be returned to the customer upon payment of postage.<\/p>\n<p>Upon receipt of the item, a discount slip will be issued and sent to the customer via email.<\/p>\n<p>&#8211; The product must be in the same condition as it was sent, unused, and:<\/p>\n<ul>\n<li>with the original labels attached;<\/li>\n<li>with the original packaging;<\/li>\n<li>accompanied by the purchase invoice or document identifying the purchase;<\/li>\n<li>without any signs of use, odors* or damage to the garment;<\/li>\n<li>without any signs of washing or alterations made by the customer, such as adjustments, hems, seams, etc.<\/li>\n<\/ul>\n<p>&#8211; The article must be sent before the corresponding deadline (14 days) expires. If the item arrives after the deadline has passed, it will be refused or returned to the customer after payment of the return postage.<\/p>\n<p>&#8211; it may take up to 14 days to receive and check the exchange.  <\/p>\n<p>HaHaArt reserves the right to refuse exchanges after the established deadline, or items that are not in the same condition as when they were purchased.  <\/p>\n<p><strong>Conditions and procedure for RETURNS:<\/strong><\/p>\n<p>The customer has the right to return their products due to withdrawal, defect or non-conformity (DL no. 24\/2014 of February 1).<br \/>However, the product must be in the same condition as it was purchased, without having been used.<\/p>\n<p>&#8211; The item must be sent to the address indicated and in accordance with the instructions given.<br \/>(shipping costs are borne by the customer, with the exception of factory defects in the item);<\/p>\n<p>The customer has 14 days to make the return, and the returned goods will only be accepted if they meet the following conditions:<\/p>\n<ul>\n<li>item intact and unused;<\/li>\n<li>with the original labels attached;<\/li>\n<li>accompanied by the purchase invoice or document identifying the purchase;<\/li>\n<li>without any signs of use, odors* or damage to the garment;<\/li>\n<li>without any signs of washing or alterations made by the customer, such as adjustments, hems, seams, etc.<\/li>\n<\/ul>\n<p>If any of these points are breached, the return will be refused (and the consequent refund).<\/p>\n<p>There are items that by their nature cannot be accepted for return. The right of withdrawal does not apply to goods which cannot be returned for hygiene reasons and which have been opened after delivery, such as jewelry and underwear (regardless of model name).<\/p>\n<p>The shipping costs and method of returning the item to HaHaArt are the sole responsibility of the customer.<\/p>\n<p>The refund process will only be initiated once the product has been received and checked for condition.<\/p>\n<\/p>\n<p><strong>Factory defect:<\/strong><\/p>\n<p>If the customer wishes to make a complaint about a defective item, they should contact us by telephone or email to resolve the problem. The customer must then send the item back with the appropriate invoice, and the complaint will then be reported to the brand.
